ORDER REGULATING CONDUCT
This cause came to be heard before the Honorable ___________________________________, Judge/Referee of this Court, all parties of interest were before the Court, and upon proof introduced and the entire record, the Judge/Referee finds that there is probable cause to believe that said child committed the offense as charged within the petition and that in the manifest best interest of said child that this Court enter an order governing and regulating the conduct of the parties, pending further hearing and disposition.
IT IS THEREFORE ORDERED
1. That each of the parties be given a copy of this Order and be warned that violation of this order may result in a violation hearing at which time the Court may order this child be committed to the Tennessee Department of Children's Services, OR the court may order such other secure placement (detention) or punishment as it deems proper within its jurisdiction.
2. The Parent/Guardian will comply with the following: Pursuant to T.C.A. 37-1-174(a)(1)(2)(3)(4)(b)(c),if an unemancipated child commits a delinquent or unruly act that brings the child within the jurisdiction of the juvenile court, and if the child.s parent or legal guardian, who is not thevictim of the act that brings the child within the jurisdiction of the juvenile court did not take reasonable steps tocontrol such delinquent or unruly conduct, then the court may order the parent or legal guardian to do one or more ofthe following:
1. Participate in the child.s program of treatment and rehabilitation
2. Seek assistance from school officials, social service officials or other appropriate public or private resources and authorities to provide treatment and rehabilitation for the child
3. Complete community service work individually or jointly with the child; or
4. Provide supervision to ensure that the child complies with any and all conditions and requirements that the court has ordered the child to do:
If the parent or legal guardian violates or refuses to comply with the order of this court, then the parent or legal guardian my be held in contempt pursuant to T.C.A. Sec. 37-1-158, and this court may fine the parent or legal guardian up to fifty dollars ($50.00), may incarcerate the parent or legal guardian in the county jail for up to ten (10) days or may impose both fine and incarceration.
_____ Ensure that the child attends school daily and is on time with homework completed.
_____ Hold meeting with the child daily to discuss the day.s events. This meeting will be a minimum of fifteen (15 Minutes and shall include topics such as: friends, problems, something they did well, special activities, home chores, how they can help at home, special plans, goals, tomorrow.s schedule, and daily events. Keep a log of these meetings.
_____ Ensure that their child fulfills all the provisions of this agreement and, if he/she does not abide by this agreement the parent MUST contact the Juvenile Office.
_____ Make contact with the school every two weeks to obtain information about the child.s attendance and inappropriate behaviors.
_____ Obtain the child.s grade reports within one week of the ending of each sIx week reporting period. If the child receives a failing grade in any subject, the parent is to arrange a conference with the teacher(s) of the fielded subject(s).
_____ Writing a behavior contract after discussion of needs, expectations, goals, parent.s role, child.s role, organization, rewards, and consequences.
_____ Enroll and complete a child management course.
_____ Contact _________________________________at the Juvenile Office every other week to report child.s progress.
_____ Provide copies of child.s grades, attendance, and discipline from the school for all court appearance for your child.
However, prior to holding such a parent or guardian in contempt, the parent or legal guardian shall be served with notice and shall be give a reasonable opportunity to be heard by the court.
3. That the child conduct him/herself as follows:
a. Obey reasonable and law abiding orders, requests or demands of parent(s) or custodian.
b. Obey all school rules and attend school and each class required every day.
c. Obey all laws including those applicable only to juveniles.
d. Obey all rules/conditions set by your assigned YSO.
e. Curfew: Sunday through Thursday________________Firday through Saturday___________________.
f. Submit to random drug screens.
